Monitoring Report in respect of Complaints Received


Summary

1.      This report is to update the Committee on the position regarding ongoing complaints.

Background

2.      The table attached at Annex A provides information about ongoing complaints and the table attached at Annex B provides the list of closed complaints. 

3.      Case reference 2021/17 was investigated and the hearing took place on 2nd September 2022 in respect of two of the three City of York Councillors named in the complaint. Part of the complaint, alleging failure to treat others with respect, was upheld in respect of the first subject member. No sanction was imposed. The complaints against the second subject member were not upheld. The complaint against the third City of York Councillor named in the same complaint was investigated and not upheld; the Joint Assessment Sub Committee confirmed this decision at their meeting on 9th August 2022.

4.      Case reference 2021/20 is closed, no breach of the code was found following an investigation. This decision was confirmed by the Assessment Sub Committee on 9th August 2022.

5.      Case references 2022/07 and 2022/15 are closed, a breach of the code was found following an investigation. Recommendation to seek informal resolution to both complaints by way of training. All parties notified and accept informal resolution.

6.      Case references 2022/13, 2022/14, 2022/16, 2022/17 and 2022/18 are currently under investigation.

7.      Case references 2022/19, 2022/21 and 2022/22 did not progress to investigation and are closed.

8.      Case reference 2022/20 is closed, no breach of the code was identified by an Assessment Sub Committee on 19th October 2022.
